Glam Diamond Studio Limited (Glam Pole & Aerial Dance Studio)


General Terms and Conditions of Studio Policy


These terms and conditions (“Terms and Conditions”) constitute a legally binding agreement between Glam Diamond Studio Limited (“Glam”, “we”, “us”, “our”) and the participant (“Participants”, “you”, “your”). By registering for the classes (as defined hereunder), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

 

Enrollment, Catch-Up Classes & Absences, & Cancelled Classes

All classes registrations once confirmed are non-refundable and non-transferable. The participants must be 18 year-old or above unless with parental/guardian permission. Catch-up classes are only allowed for classes and levels that match the original class and must be completed within the same term. Late catch-ups will not be accommodated. To schedule a catch-up class, the student must release original class at least 6 hours in advance via the registration system and immediately select a replacement class. Late requests will not be accepted. We reserve the right to exercise discretion in exceptional cases, and all decisions made shall be final and conclusive. No catch-up class can be arranged for class cancelled due to non-controllable events like wars, civil riots, acts of terrorism, epidemics, acts of nature, fires, strikes, government restriction or other circumstances beyond Glam’s control.

 

Bad Weather Policy

In the interest of the participant’s safety, Glam reserves the right to cancel classes when a venue is deemed dangerous due to inclement weather.  


Class Arrangement under Rainstorm Warning Signal:- 

Under Amber, Red Signal:

All classes as usual. 


Under Black Signal:
If issued during the class, the next class will be cancelled.
All classes will resume within 2 hours after Black Signal is lowered. 

 

Class Arrangement under Typhoon Warning Signal:-
Under Typhoon Signal No.1 & No. 3:
All classes as usual.


Under Typhoon Signal No.8 or above:
If hoisted within 2 hours before class, the class will be cancelled.
When Signal No.8 or above is in force, all classes are cancelled.  
All classes will resume within 2 hours after Signal No.8 is lowered. 


During affected weather, Glam will update the Instagram story alert on our class status from time-to-time as well.

 

Health and Safety

In order that we maintain appropriate standards of health and safety, you are responsible for disclosing any prior medical or physical conditions on this form and also to the teacher before the class starts. If you are in any doubt as to the suitability of the course please consult your doctor. You expressly acknowledge that engagement in dance under the care and supervision of Glam Diamond Studio Limited (“Glam”) in the course of tuition or as a matter of free form dance in pole dance engagement, is a physical demand and that engagement in dance may occasion falls, sprains or twisted ligaments, respiratory or cardiovascular stress (in persons with respiratory or cardiovascular disabilities). 


The participants covenant with Glam that you have sought all appropriate medical advice prior to the acceptance of this invitation to ensure you in good physical condition fully able to undertake the pole dance at the date hereof and further, the participants accepts and assumes all responsibility for any loss, damage, injury or adverse consequence suffered by the participants as a result of engaging in dance and indemnifies Glam in respect of any claim by or through the participants in the event of injury to or demise of the  participants as a consequence of engaging in dance class hosted in Glam or its partnering locations, excluding only loss or damage suffered as a direct consequence of negligent breach of duty of care by Glam Diamond Studio Limited. The participants acknowledge that some physical contact may be necessary by the course instructor.

 

Liability

Glam does not accept liability for personal injury or death of any participants in Glam Diamond Studio Limited unless directly caused by the proven negligence of the company or its staff. 

 

Exclusions and Withdrawals

If a participant is persistently disruptive, have infectious disease or with any symptoms of one (such as high temperature, cough, runny nose, fever or rash), or if we feel their attendance affects the good atmosphere of the course or Glam, we have the right to exclude them from the class. Glam has the right to examine the participants true copy of HKID/PASSPORT for verification on the registered information, failure to do so may result in the withdrawal to Glam classes.

 

Photography and Other Media

Glam and its business partner / teacher reserves the right to use photographs/videos taken in-class or events for marketing and promotional purposes. All photos and videos may ONLY be taken during the class, and focusing only on their own and not on the others. Photos/videos taken by the student/ attendee can only be for personal use. Glam reserves the right to stop the participants from taking the photo/video when disruption to class or event occurs inside/outside the studio.

Live Stream Classes 

Live stream class/ Meeting Link is strictly prohibited from being shared with others who are not invited by Glam. Glam’s age policy also applies to live stream class. Same appropriate in-class behaviour is expected during these live stream classes. Class fees settled/ arrangement confirmed for the live stream dance class are non-refundable, non-transferable nor credit. Class might be cancelled due to any non-controllable events, like wars, civil riots, acts of terrorism, epidemics, acts of nature, fires, strikes, government restriction or other circumstances beyond Glam’s control and no catch-up classes will be arranged. No catch-up classes can be arranged for any missed live stream class. The class is one-way communication by the instructor. Instructor will determine the pace of the class. No chatting will be engaged between students. Instructor will have the right to ask student to leave or end the live stream platform for any inappropriate behaviour or disturbance in the class.

All instructors and students conducting the class will be able to see each other.  No video recording, photography or sharing is allowed. To protect the interest of our participants and Glam, Glam may take legal action for any breach on the privacy. Participants must evaluate the risks when using Zoom application for the session, Glam will not be responsible for any loss or liability associated with it.

 

Disclaimer

The Studio Policies and Information set out are subject to change without prior written notice from Glam. It is the participants responsibility to check on the Studio Policies and Information of Glam from time to time, the latest Studio Policies and Information will be on our website (http://www.glam.com.hk/terms). We retain the right of final decisions and interpretation in all matters and disputes in relation to the registration and programs. We shall not be responsible or liable for any claims or liability resulting from the registration, classes or programs suffered or incurred.

Your privacy is important to Glam. This Privacy Policy (“Policy”) explains how Glam collects, uses, discloses, and retains your information when you visit or use our website (our “services”), including the use of personal information in connection with interest-based advertising. It also describes the controls we provide you with to manage your personal information within our services and your data subject rights. Please read through the following before providing us with any of your personal data. When you provide Glam with your personal data, you consent to use, disclosure, and retention of your personal data in accordance with this Privacy Policy and as otherwise permitted by law.

How Glam uses your personal  information

How Glam shares your personal information


In order to provide the above services to you, we may share your personal data with the following entities:

  • Companies involved in running our website, getting your purchases to you, such as payment service providers, warehouses, order packers, and delivery companies;
  • Companies involved in running our loyalty program (if you participate in the program);
  • Professional service providers, such as marketing agencies, and 3rd party platform providers, who help us to run our business;
  • Companies approved by you, such as social media sites (if you choose to link your account to us); and
  • Law enforcement and fraud prevention agencies or anybody required by law.


In addition, through our Services, we may allow third party advertising partners to set Technologies and other tracking tools to collect information regarding your activities and your device (e.g., your IP address, mobile identifiers, page(s) visited, location, time of day). We may also combine and share such information and other information (such as demographic information and past purchase history) with third party advertising partners. These advertising partners may use this information (and similar information collected from other websites) for purposes of delivering targeted advertisements to you when you visit third party websites within their networks. We may allow access to other data collected by the Services to share information that may be useful, relevant, valuable or otherwise of interest to you. Some of the information that we collect will not personally identify you but will instead track your use of our website so that we can better understand how our website is used by end users and in turn enhance and improve your experience in using our website. This information can be obtained through the use of cookies. Our websites do not respond to Do Not Track signals because we do not track our users over time and across third-party websites to provide targeted advertising. However, we believe that you should have a choice regarding interest-based ads served by our partners, which is why we outline the options available to you above.

 

 

Accessing And Correcting Your Personal Data


You may review and correct your personal data by signing into your user account and selecting 'Update Profile' or equivalent, or by contacting us at glamaerialdance@gmail.com. We will only disclose personal data to the individual who registered his/her personal data with our website, and only after confirming the identity of the registered party. Please allow fourteen (14) working days for your request to be processed. In relation to any request for access to any personal data, we reserve the right to charge a nominal fee for the processing of this request in accordance with applicable local legislation.


Deletion of your account with us will not automatically delete the personal data held about you. If you would like to request that we delete all personal data together with the deletion of your account, please follow the steps under Request for Deletion of Personal Data.

 


Request for Deletion of Personal Data


You have the right to request that we delete any of your personal data that we collected from you and retained, with certain exceptions. If you would like to withdraw your consent for the collection, use and/or disclosure of any of your personal data, please write to us at glamaerialdance@gmail.com. We will process such a request and it may take up to thirty (30) days for this to be reflected in our systems. Once this is complete, we will no longer retain, use and/or disclose your personal data, except for compliance, regulatory or other legal purposes. Our ability to comply with your deletion request is subject to any applicable legal or other requirement to maintain certain records of your personal data. Please note that the deletion of your personal data from our database will result in us not being able to provide you with the products or services that you have requested from us.

 


Opting-Out


If you would like to unsubscribe from our newsletter, or opt-out of our loyalty program detailed instructions are provided at the bottom of all emails sent out. If you would like to unsubscribe from any of our other mailing lists, please write to us at hello@glam.com.hk. Please allow thirty (30) working days for your request to be processed.


 

Amendments


We reserve the right to amend this Privacy Policy at any time. The Effective Date stated below indicates the last time this Privacy Policy was revised. Any changes we may make to this Privacy Policy in the future will be posted on our website. You are encouraged to review this page periodically to see any updates or changes to our Privacy Policy.

General Terms & Conditions of Glam Card

The Glam Card (Loyalty Card)
⁃ This Agreement is of immediate effect.
⁃ This Agreement is a contract between the Holder of the Glam Card ("the Card Holder") and Glam Diamond Studio Limited ("GLAM"), the issuer of the Card.
⁃ This Agreement explains Glam’s obligations to you as the Card Holder when applying for and using the Card.
⁃ By using the Card, the Card Holder agrees to the terms of this Agreement.

Card Holder's Account
⁃ The Card can only be used in purchase for goods and to accumulate points at any of the Glam’s studio in Hong Kong or the App. GLAM reserves the right not to accept any Card if GLAM reasonably believes that the use is unauthorized, fraudulent or otherwise unlawful.
⁃ Unless otherwise required by law, no change or cash refund will be provided and no interest will be credited to the Card Holder by GLAM.
⁃ A unique and verified mobile number is required for each account.
⁃ The Card cannot be exchanged or transferred.
⁃ Only one Card can be used in each transaction.

Loading Value on the Card:
⁃ No preload value is required for e-card activation at Glam’s mobile app “Glam Hong Kong”. 
⁃ To add value to the Card for future consumption, a minimum of HK$1 is required. The maximum stored value of the Card is HK$20,000. GLAM may change the maximum and minimum amounts at any time by notifying the Card Holder at the point of sale or on GLAM website.
⁃ The Card Holder can use card balance to settle full or partial payment for goods purchased at any of Glam’s studio. Card balance can only be used to settle full payment for goods purchased on the App.
⁃ GLAM voucher cannot be converted into any value in the Card.

Check Balance/Expiry Date:
⁃ The Card Holder can check the Card balance at Glam’s studio, on Glam’s mobile app “Glam Hong Kong” (the App) or by calling Glam customer service hotline at 9879 2078.
⁃ The Card Holder can check the expiry date at any of the Glam’s studio or by calling Glam customer service hotline at 9879 2078.
⁃ Unused amount and/or point balance shall be forfeited automatically upon the expiry date.
⁃ Card balances are real time update and be reflected in the system.
⁃ Card balances cannot be exchanged or redeemed in any way for cash.

Cancellation of the Card
⁃ No refund for any Card cancellation. Glam will deactivate the Card upon receiving Card cancellation request.

Replacement of the Card
⁃ GLAM is not responsible for any unauthorized transaction associated with the Card.
⁃ Customer are suggested to purchase a new card from our Glam’s studio via APP and email to glamaerialdance@gmail.com for Cash balances and Points transfer.

Billing Errors, Corrections
⁃ GLAM reserves the right to correct the balance of the Card if Glam believes that a clerical, billing or accounting error has occurred. If the Card Holder have any questions regarding transaction history or any such correction, or if the Card Holder disputes any transaction or correction that has been assessed against the Card, please contact GLAM Customer Service Team at 9879 2078. GLAM will conduct an investigation and communicate the results and correct any error that GLAM verifies as soon as GLAM finishes the investigation. If no error is found, GLAM will provide an explanation. GLAM shall have no liability for any billing error unless the Card Holder notifies GLAM within Sixty (60) days of the date of the transaction in question. The Card Holder should monitor the transactions and account balances closely.


Changes to this Agreement
⁃ Use of the Card constitutes the Card Holder's acknowledgement of and the agreement to abide by the terms and conditions set forth in this Agreement.
⁃ GLAM reserves the right to amend the terms and conditions at its discretion, including any rights or obligations the Card Holder or GLAM may have without prior notice.
⁃ As permitted by applicable law, any change, addition or deletion will become effective at the time GLAM posts the revised agreement to its website. Unless GLAM states otherwise, the change, addition or deletion will apply to the Card Holder's further and existing Cards.

Termination
⁃ GLAM may suspend or terminate this Agreement or revoke or limit any or all of the rights and privileges granted to the Card Holder at any time without notice or liability. Termination may result from the Card Holder's fraudulent or unauthorized use of the Card. If GLAM terminates this Agreement without cause, GLAM will refund the balance held in the Card account less any amounts that the Card Holder may owe to GLAM.

Indemnity
⁃ The Card Holder agrees to indemnify GLAM against all actions, proceedings, liabilities, claims, loss, damages and reasonable costs and expenses which may be taken against GLAM or which GLAM may suffer, sustain or incur (as the case be) in respect of the Card unless the same were caused by any manifest error on GLAM's part.

Disclaimers and Limits of Liability
⁃ GLAM and its affiliates make no representations, warranties or conditions of any kind, express or implied, with respect to the Card, including, but not limited to, any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement, or any warranty arising by usage of trade, course of dealing or course of performance. GLAM does not represent or warrant that the Card will always be accessible or accepted.
⁃ In the event that GLAM or its affiliates are found liable to the Card Holder, the Card Holder shall only be entitled to recover actual and direct damages and such damages shall not exceed the last balance held on the Card. GLAM and its affiliates shall have no liability for any incidental, indirect or consequential damages (including without limitation loss of profit, revenue or use) arising out of or in any way connected with this Agreement, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, even if GLAM or its authorized representatives have been advised of the possibility of such damages.
⁃ In no event shall GLAM or its affiliates have any liability for unauthorized access to, or alteration, theft or destruction of the Card through accident, misuse, or fraudulent means or devices by the Card Holder or any third party, or as a result of any delay or mistake resulting from any circumstances beyond GLAM's control.


Personal Data

Notice to the Card Holder relating to the Personal Data (Privacy) Ordinance ("the Ordinance"):
⁃ It is necessary for each of the Card Holder to provide his/her personal data to GLAM from time to time in connection with obtaining or continuing to use the Card.
⁃ If the Card Holder is unable or unwilling to provide such correct data, GLAM may be unable to provide the Card Holder with the service.
⁃ Each of the Card Holder agrees that his/her personal data provided to GLAM relating to the Card may be used for the following purposes:-

(a) processing the application for the Card;
(b) verifying any information and records relating to the Card Holder;
(c) enforcing and exercising GLAM's rights under this Agreement;
(d) the normal management, operation and the maintenance of the Card system, including audit;
(e) designing new or improving existing services provided by GLAM, GLAM’s subsidiaries and affiliates (i.e. any other entity which directly or indirectly controls GLAM, is controlled by PCC, or is under common control with GLAM) for customer's use;

(f) marketing of goods and/or services by GLAM, GLAM’s subsidiaries and affiliates or any of GLAM’s selected business partners;

(g) communication from GLAM to the Card Holder;

(h) investigation of complaints, suspicious transactions and research for service improvement;

(i) prevention or detection of crime;

(j) disclosure as required by law; and

(k) other related purposes.

⁃ Data held by GLAM relating to the Card Holder is kept confidential by GLAM, but each of the Card Holder agrees that for the purposes set out in the above clause, GLAM may transfer or disclose such information to the following parties (whether within or outside the Hong Kong Special Administrative Region):

(a) any relevant service providers under a duty of confidentiality to GLAM;

(b) any agent, contractor or third party service provider (under a duty of confidentiality to GLAM) who provides administrative, telecommunications, computer, payment, data processing or other services in connection with the operation of GLAM’s business;

(c) any other person under a duty of confidentiality to GLAM including GLAM’s subsidiaries, affiliates or business partners; and

(d) any person to whom GLAM, our subsidiaries, affiliates or business partners in (c) above, is under a binding obligation to make disclosure under the requirements of any law, rule and regulation, including those of countries outside of Hong Kong for data transferred to those countries, but such disclosure will only be made under proper author
⁃ Each of the Card Holder has the right to:

(a) check whether GLAM holds data about the Card Holder and have access to that data;
(b) require GLAM to correct any data relating to the Card Holder which is inaccurate;
(c) ascertain GLAM’s policies and practices in relation to personal data and to be informed of the kind of personal data held by GLAM; and
(d) request GLAM not to use the personal data of the Card Holder for direct marketing purposes, which GLAM will cease to do at no cost to the Card Holder.
⁃ GLAM reserves the right to charge the Card Holder a reasonable fee for processing any request for access to his/her personal data.
⁃ Any request for access to data or correction of data or for information regarding our policies and practices and kinds of data held by GLAM should be made in writing addressed to:

Unit B-C, 36/F, COS Centre, 56 Tsun Yip Road, Kwun Tong, Kowloon, Hong Kong.
⁃ If Card Holder does not want to receive marketing materials from GLAM in the future, Card Holder may write to GLAM at the above address or call GLAM on 9879 2078.
⁃ Nothing in this Notice shall limit the rights of the Card Holder under the Ordinance.

Assignment
⁃ GLAM may assign all or part of its rights or obligations under this Agreement without notice to the Card Holder provided that GLAM complies with all applicable laws, regulations in respect of such assignment, GLAM shall be released from all liability.
Governing Law
⁃ This Agreement shall be governed by and construed in accordance with the laws of Hong Kong Special Administrative Region of the People's Republic of China.

Entire Agreement
⁃ This Agreement is the complete and exclusive statement of agreement between the Card Holder and GLAM, and supersedes and merges all prior proposals and all other agreements. In the event that any provision of this Agreement shall be determined to be illegal or unenforceable, that provision will be eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. Headings herein are for convenience of reference only and shall in no way affect interpretation of this Agreement.Should there be any dispute, GLAM reserves the right of final decision.
